Welcome to hiired. ("we", "our", or "us"). These Terms & Conditions govern your access to and use of our website, mobile application, and marketplace service. By registering on our platform, joining our waitlists, or using the hiired. app to discover or post local daily or hourly work opportunities, you agree to comply with and be bound by these terms.
Please read these Terms carefully before using the platform. If you do not agree with any part of these terms, you are not permitted to use our services.
2. eligibility
To use hiired., you must meet the following eligibility requirements:
- Age Requirement: You must be at least 18 years old to register and use the platform in any capacity — as a worker or as a provider.
- Self-Declared Information: Users are responsible for ensuring that all information provided on their profiles is accurate and truthful. hiired. does not independently verify the identity, education status, qualifications, experience, or background of any worker or provider. Any information provided regarding educational status, skills, or experience is self-declared by the user.
- Legal Capacity: You must have the legal capacity to enter into binding agreements under applicable Indian law.
3. marketplace nature of service
hiired. operates solely as a digital marketplace that facilitates introductions between workers and providers. hiired. is not a party to any employment relationship, service agreement, payment arrangement, or contract formed between users of the platform.
You acknowledge and agree that:
- Technology Platform Only: hiired. is a technology platform and marketplace only. hiired. is not a staffing agency, employment agency, labor contractor, recruitment agency, employer, contractor, or representative of any worker or provider.
- No Employment Relationship: Workers matched through the platform are not employees, agents, or partners of hiired. hiired. does not employ, supervise, direct, control, or monitor any worker.
- No Verification: hiired. does not verify and makes no representations regarding the identity, legitimacy, qualifications, reliability, skills, background, or conduct of any user on the platform.
- Direct Arrangements: All work arrangements, agreements, and obligations are formed directly and exclusively between the worker and the provider. hiired. is not a party to any such arrangement.
- Discovery Only: hiired. facilitates discovery and initial communication between workers and providers. Any agreement to perform or accept work is made solely at the discretion and risk of each individual user.
4. user responsibilities
All users of hiired., whether workers or providers, are responsible for:
- Accurate Information: Providing truthful, complete, and up-to-date information on their profile and in all communications on the platform.
- Due Diligence: Conducting their own independent assessment of any worker or provider before entering into any work arrangement. hiired. does not guarantee the identity, legitimacy, qualifications, reliability, or conduct of any user.
- Legal Compliance: Complying with all applicable laws, regulations, and local labour requirements relevant to any work arrangement made through the platform.
- Account Security: Maintaining the confidentiality of their account credentials and being responsible for all activity that occurs under their account.
5. worker responsibilities
Workers using hiired. to discover and apply for shifts agree to the following:
- Truthful Profiles: All details on your profile, including any information regarding education, skills, or work experience, must be completely truthful and accurate. hiired. does not verify these details and is not responsible for any misrepresentation you make to a provider.
- Commitment: If you agree to take on a shift with a provider, you are entering into a direct agreement with that provider. hiired. is not a party to that agreement.
- Conduct: You are responsible for your own professional conduct, safety, and performance during any shift. Any disputes arising from your work must be resolved directly with the provider.
- Platform Use: You agree to use the hiired. platform only for its intended purpose of discovering work opportunities.
6. provider responsibilities
Providers using hiired. to discover and connect with workers agree to the following:
- Accurate Job Listings: You must provide clear and accurate information in your job listings, including the nature of work, location, hours, and the payment rate you are offering. hiired. is not responsible for any inaccuracies in your postings.
- Safe Workplace: You are solely responsible for ensuring a safe, respectful, and legally compliant working environment for any worker you engage through the platform.
- Cancellations: Providers are encouraged to provide reasonable notice to workers before cancelling or modifying a shift. Any consequences arising from late cancellations are a matter solely between you and the worker.
- Legal Obligations: You are responsible for compliance with all applicable labour laws, tax obligations, insurance requirements, and workplace safety regulations in connection with any worker you engage.
7. payments & fees
- No Payment Processing: hiired. does not process, collect, hold, escrow, or distribute payments between workers and providers. All payment arrangements, payment methods, payment disputes, and settlement obligations are solely between the provider and the worker.
- Transparent Listings: Providers are encouraged to clearly state the payment rate in their job listings. However, hiired. is not responsible for any payment disputes, non-payment, underpayment, or payment delays that arise between users.
- Platform Fees: Joining the waitlist and using early versions of the platform is currently free. hiired. reserves the right to introduce service fees, subscription charges, or other commercial structures in the future, which will be communicated in advance.
8. disputes between users
Any disputes relating to work quality, attendance, compensation, conduct, working conditions, injuries, damages, or any contractual obligations must be resolved directly between the worker and the provider. hiired. is not a party to such agreements or disputes and has no obligation to mediate, arbitrate, or resolve any dispute between users.
hiired. may, at its sole discretion, provide a mechanism for users to report concerns or flag conduct that violates these Terms. However, hiired. is under no obligation to take any particular action in response to such reports and is not liable for the outcome of any user dispute.
9. prohibited conduct
Users must not engage in any of the following on the hiired. platform:
- Misrepresentation: Providing false, misleading, or fraudulent information on your profile or in any communication on the platform.
- Harassment and Abuse: Any form of harassment, discrimination, threats, verbal abuse, or intimidation towards any other user.
- Illegal Activity: Using the platform in connection with any unlawful purpose or in violation of any applicable law or regulation.
- Scamming or Fraud: Attempting to defraud, deceive, or exploit any other user of the platform.
- Platform Misuse: Using the platform to collect data about other users, spam users, or engage in any activity that interferes with the proper functioning of the platform.
hiired. reserves the right to suspend or permanently remove any user from the platform for violations of these rules, at its sole discretion.
10. limitation of liability
Disclaimer: hiired. does not guarantee the identity, legitimacy, qualifications, reliability, or conduct of any user. Users are responsible for conducting their own due diligence before entering into any work arrangement.
hiired. is not liable for any direct, indirect, incidental, special, or consequential damages arising from your use of the platform, including but not limited to: disputes between users, non-payment, personal injury, property damage, loss of earnings, or reputational harm.
hiired. makes no warranties, express or implied, regarding the accuracy, reliability, or completeness of any information on the platform, or the suitability of any worker or provider you connect with through the platform.
You use the hiired. platform entirely at your own risk and discretion.
11. future features & changes
hiired. is an evolving platform. We may introduce additional features, services, or changes at any time, including:
- Subscription plans or premium tiers for providers or workers
- Optional identity or background verification programs (operated by third-party providers)
- In-app payment facilitation tools or integrations
- Advertising or promotional services for providers
- Rating and review systems
- Expanded geographic coverage or job categories
Any such features will be governed by separate terms, pricing, or policies communicated at the time of launch. Continued use of the platform after such changes constitutes acceptance of the updated terms.
hiired. also reserves the right to modify, suspend, or discontinue any part of the platform at any time, with or without notice.
12. governing law
These Terms shall be governed by and construed in accordance with the laws of India. Any legal actions, claims, or disputes arising out of or in connection with these Terms shall be subject to the exclusive jurisdiction of the competent courts in Kochi, Kerala.
